TERMS AND CONDITIONS FOR “For Diversity. Against Discrimination and the 2007 European Year of Equal Opportunities for All” COMPETITION
1. This competition will be governed by these terms and conditions and entrants agree that they have read and understood these terms and conditions and will be bound by them.
2. Entrants may enter the competition by uploading their entry (“The Material”) at url www.eudiversity.com. Costs to enter the competition via the Internet may vary so please check with your network operator for current charges. Entrants should seek the permission of the person paying the bill before entering.
3. Entrants may upload one entry each. The Material does not need to have been made specifically for the competition nor do they need to be newly created but the Material must be original, have been created by the Entrant and not any other third party and must not contain any third party copyright material (e.g. photos, footage, music, lyrics, graphics or other artwork, etc).
By entering the competition and by reading and accepting these terms and conditions, entrants acknowledge that the Promoter may (but is under no obligation to) exhibit and/or distribute the Material in whole or in part in any and all media now known or hereafter invented. For the avoidance of doubt, the ownership of the Material shall remain with the Entrant.
By entering the competition and by reading and accepting these terms and conditions, entrants confirm that they have all necessary authority to grant the rights to give the Promoter the Material (including without limitation the necessary consents, rights and permissions from any person) and to allow the Promoter to transmit, broadcast and otherwise distribute the Material in whole or in part without limitation forever without payment by the Promoter or it’s sub-licensees, and that the entrant shall indemnify the Promoter against any and all claims that may arise out of transmission of the Material provided to the Promoter by them. Entrants also confirm that they waive any moral rights they have in the Material for the purposes of the Promoter using the Material as permitted in these terms and conditions.
4. The closing date for entries is 23.59hrs on 8 December 2007.
5. This competition is open to residents of Europe only, excluding employees of the European Commission, or any other person professionally connected with this competition.
6. Entries must include name, age, address, (including postcode), telephone number of entrant and their upload of their Material.
7. Entrants who are under 18 must obtain permission to enter this competition from their parent or legal guardian.
8. The Winner will be the entry that receives the most votes in the period 10 December to 16 December 2007.
9. The prize is as follows:
A trip for the winner and a guest to spend a weekend in a city of his/her choice in the EU
A digital camera to shoot pictures of 'diversity' at the chosen location.
Prize includes
Round trip flights from the winner’s country of residence to his/her destination of choice,
2 nights accommodation in a double room at a 4 star hotel , breakfast at the chosen location, airport transfers to and from the hotels at the location, spending money of 500€, travel insurance for the trip for the winner and the winner’s guest.
This prize does not include:
The telephone bills and costs of the winner and the winner’s guest or additional meals and drinks.
The winner and his or her guest are responsible for all applicable taxes and expenses not specified in the prize description other than taxes charged in relation to all flights which shall be paid.
For the avoidance of doubt, if the winner is under eighteen (18) years, the winner’s guest must be a parent or legal guardian.
In the event that the date of the trip falls within school term-time, the winner and/or the winner’s guest as relevant must obtain the prior written consent of their headteacher and their parent/legal guardian for their absence from school.
The trip must be taken within six (6) months of the closing date. The exact dates for travel shall remain subject to availability.
The winner and the winner’s guest must hold a valid passport and any other necessary travel documentation (including, without limitation, visas where necessary).
10. For the avoidance of doubt, the prize does not consist of anything other than expressly set out in paragraph 7 above and no additional costs (including, without limitation, spending money in excess of the figure specified, are included).
11. The winner is responsible for all applicable taxes and expenses not specified in the prize description.
12. The Winner will be notified by telephone within one week of the date of selection, and where necessary will receive written confirmation and full details of the prize by post within fourteen days of selection.
13. The Promoter’s decision is final with respect to any aspect of the competition. No correspondence will be entered into.
14. Entrants agree that the Promoter may use the entrant’s entry, name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants and/or any statement made by them concerning the competition and/or the prize(s) in connection with publicizing the competition, in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.
15. By entering this competition, all entrants hereby grant the Promoter the exclusive right to film, tape, sound record and photograph all their activities in connection with the competition and (if applicable) any prizes. Everything filmed, taped or recorded by the Promoter shall be known as “Footage”.
16. All entrants hereby irrevocably and unconditionally assign to the Promoter full title guarantee (and by way of present assignment of present and future rights) all intellectual property rights in any “Footage” throughout the world for the full unexpired period of such rights and all renewals, reversions and extensions of such period as may be provided under any applicable law throughout the world.
17. All entrants hereby irrevocably and unconditionally waive in favour of the Promoter, the Promoter’s affiliates and their licensees, assigns and successors in title, all moral rights in any “Footage” to which he or she is, or may at any time in the future be, entitled.
18. The Promoter reserves the right to select an alternative prize winner in the event that the Promoter has reasonable grounds for believing that a selected winner has contravened any of these Terms and Conditions.
19. The winners may be required to provide a written acknowledgement of acceptance of all terms and conditions of the competition along with a parent’s or legal guardian’s signature prior to receiving their prize.
20. The Promoter can accept no responsibility for entries lost, delayed, misdirected, damaged or undelivered. Incomplete, inaudible, and/or illegible entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition.
21. The prize is as stated and is non-transferable. No cash alternative will be offered. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide any stated prize(s), the Promoter reserves the right to award a substitute prize of equal value. All prizes are subject to the additional terms and conditions of the manufacturer or supplier.
22. No purchase necessary.
23. By entering the competition, entrants acknowledge that they may be required to be used in publicity without further consent or payment. Such publicity may include without limitation the entrant’s name and/or likeness, voice, photographs and/or video footage of the entrant, biographical information provided by the entrants and/or any statement made by them concerning the competition and/or the prize(s). Entrants agree that any or all such elements may be used by the Promoter in any and all media in perpetuity throughout the world as the Promoter in its sole discretion sees fit.
24. The Promoter shall not be liable to the winners and/or any guests and/or parents/legal guardians for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the competition and/or prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s personnel and/or deceit or fraud by Promoter and/or Promoter’s personnel.
The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winners and/or any guests and/or parents/legal guardians under these Terms and Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays, changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes or arising without limitation out of or in connection with (i) the activities of third party event organisers; (ii) any form of transportation (including but not limited to flights, trains, coaches, buses, ferries, taxis or cars); and/or (iii) by third parties providing accommodation included in the prize. For the avoidance of doubt, the affected winners and/or any guests and/or parents/legal guardians shall be solely liable for any additional costs incurred as a result.
25. Any personal information, including without limitation, the entrant's name, age, address (including postcode), telephone number and/or email address will be used solely in connection with this competition and as set out in these Terms and Conditions and will not be disclosed to any third party, except for the purpose of fulfilling the prize(s) where applicable. Any personal information held by the Promoter in respect of any competition will be held on record for a short period for the purpose of ensuring fulfilment of the competition and then destroyed.
26. All entrants agree to be bound by these Terms and Conditions, which may be amended or varied at any time by the Promoter on notice.
27. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and the courts of England shall have exclusive jurisdiction in relation to any disputes arising therefrom.
